These Terms of Service ("Terms") govern your use of the 3ON Entertainment Group Artist Landing Page platform ("Service") operated by 3ON Entertainment Group in partnership with SmartersWEB Tech. By submitting a request or using our Service, you agree to these Terms.

1. The Service

3ON Entertainment Group provides professional artist landing pages, Electronic Press Kits (EPKs), and music promotion services for musicians, bands, DJs, and performers. Our Service includes:

• Custom artist landing page creation and hosting
• Electronic Press Kit (EPK) features
• Analytics and performance tracking
• Radio network promotion (Radio plan)
• Social media promotion (Radio plan)
• Artist dashboard for managing your page

2. Account Registration & Eligibility

• You must be at least 18 years old to use our Service
• You must provide accurate and complete information when submitting your artist request
• You are responsible for maintaining the security of your account credentials
• One account per artist or band is permitted
• We reserve the right to refuse service to anyone for any reason

3. Plans & Pricing

Free Plan — $0/month

Basic artist landing page with up to 5 links, bio, and profile photo. 3ON branding included.

Plus Plan — $3.99/month

Full EPK features including unlimited links, music player, photo gallery, booking form, tour dates, analytics, custom domain support, and removal of 3ON branding.

Radio + Social Plan — $7.99/month

Everything in Plus, plus 3ON Radio Network airplay, social media promotion, featured artist spotlights, playlist placements, press release distribution, and a dedicated account manager.

4. Payment Terms

• Payment is only required after your page is built and you approve it
• Subscriptions are billed monthly on the date you activate your plan
• All prices are in USD
• We use secure third-party payment processors — we do not store your card information
• Failed payments may result in service suspension after a 7-day grace period

5. Cancellation & Refunds

• You may cancel your subscription at any time — no cancellation fees
• Cancellation takes effect at the end of your current billing period
• We offer a 7-day money-back guarantee for new paid subscribers
• Refunds are not provided for partial months after the 7-day period
• Free plan accounts may be cancelled at any time with no charge

6. Your Content & License

You retain full ownership of all content you provide (bio, photos, music, links). By submitting content to our platform, you grant 3ON Entertainment Group a non-exclusive, royalty-free license to display, reproduce, and distribute your content solely for the purpose of operating and promoting your artist page and our services.

You represent and warrant that:

• You own or have the right to use all content you submit
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable laws

7. Prohibited Uses

You may not use our Service to:

• Submit false, misleading, or fraudulent information
• Impersonate another artist, person, or entity
• Upload content that is illegal, defamatory, or infringes copyrights
• Attempt to hack, disrupt, or gain unauthorized access to our systems
• Use our platform for spam or unsolicited communications
• Violate any applicable local, national, or international laws

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience outages. We are not liable for any losses resulting from service interruptions.

Artist pages are typically set up within 24-48 hours of submission approval. This timeline is an estimate and not a guarantee.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay for your subscription. Upon termination, your artist page will be taken offline. You may request a copy of your data within 30 days of termination.

10. Limitation of Liability

To the maximum extent permitted by law, 3ON Entertainment Group and SmartersWEB Tech shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our Service.

11. Disclaimer of Warranties

Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Governing Law

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of British Columbia.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by email or platform notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.
